Citizenship through marriage

I am a foreign citizen. I married a Portuguese citizen and have been married for more than 3 years. I wish to obtain Portuguese citizenship. What should I do?

The following documents will be required:

The signature of the applicant will require notary authentication. To that end, the form must be signed in a Consulate or in a Public Notary. If signed in a Public Notary, the applicant must collect the international certification «apostille» through the office of the Secretary of State of the location where the Public Notary operates. For example, in the case of a Public Notary located in MA, the «apostille» is issued by the Secretary of the Commonwealth (https://www.sec.state.ma.us/pre/precom/comidx.htm ).

-  Original long form Birth Certificate of the applicant.

This document must have an international certification. In the case of US birth certificates the intertional certification is given by «apostille». The «apostille» is issued by the Secretary of the State that issued the certificate. For example, in the case of a certificate issued in MA, the «apostille» is issued by the Secretary of the Commonwealth - the applicant must collect the international certification «apostille» through the office of the Secretary of State of the location where the Public Notary operates. For example, in the case of a Public Notary located in MA, the «apostille» is issued by the Secretary of the Commonwealth: https://www.sec.state.ma.us/pre/precom/comidx.htm 

If written in a foreign language, the certificate must be translated. If written in English, the translation may be done by the Consulate (newbedford@mne.pt) or by a professional translator. If written in other languages, the translation can be done by a professional translator. When a translation is done by a professional translator, it will need notary authentication by a Public Notary, which in turn will require the applicant to collect the international certification «apostille» through the office of the Secretary of State of the location where the Public Notary operates. For example, in the case of a Public Notary located in MA, the «apostille» is issued by the Secretary of the Commonwealth - https://www.sec.state.ma.us/pre/precom/comidx.htm 

- Certified copy of the applicant's valid passport. If certified in a Public Notary, the applicant must collect the international certification «apostille» through the office of the Secretary of State of the location where the Public Notary operates. For example, in the case of a Public Notary located in MA, the «apostille» is issued by the Secretary of the Commonwealth - https://www.sec.state.ma.us/pre/precom/comidx.htm  .

- Original criminal record certificate issued by the FBI (Federal Bureau of Investigation - https://www.fbi.gov/services/cjis/identity-history-summary-checks ), apostilled by the State Department - https://travel.state.gov/content/travel/en/records-and-authentications/authenticate-your-document/office-of-authentications.html and followed by a translation to Portuguese. The translation may be done by the Consulate (newbedford@mne.pt) or by a local translator. If done locally, it will need notary authentication by a Public Notary, which in turn will require the applicant to collect the international certification «apostille» through the office of the Secretary of State of the location where the Public Notary operates. For example, in the case of a Public Notary located in MA, the «apostille» is issued by the Secretary of the Commonwealth - https://www.sec.state.ma.us/pre/precom/comidx.htm  .

- If the applicant resided more than six months in other countries, it must be submitted an original criminal record certificate issued by each country of residence. The same rules mentioned above regarding translation apply (the Consulate will only translate documents in English). The international certification will vary in accordance with the country of issuance.

- Proof of liaison to the local Portuguese community or Portugal; (this proof should evidence links to various factors relating to your home, your language, as well as cultural, social, family, economic, and professional aspects …) - Note: In the case of a marriage with a minimum duration of six years, the absence of an effective connection to the Portuguese community does not constitute basis of oposition;

- Birth Certificate of your Portuguese spouse, with the annotation of your marriage

- Proof of registration of the marriage in the Portuguese system:

  2. Request the registration: http://www.consulateportugalnewbedford.org/us/serv_cons-us/casamento-us.php 

Once all the steps are concluded, the petition with all supporting documentation, as well as payment in Euros (see below), mail directly to the Conservatória dos Registos Centrais in Portugal for final review.

Fee: 250.00 EUROS – Bank check in EUROS, from a bank with representation in Portugal, payable to IRN, IP or by credit card: https://crcpagamentos.irn.mj.pt/pagvisamc.aspx?productid=NAC3  (please do not forget to print the proof of payment sent to email address provided by the applicant in the payment form. That print out must be included in the documentation to be sent to Portugal).
